- Birth*: John Counts Jr was born circa 1765.
- Marriage*: John Counts Jr married Margaret Kelly, daughter of (?) Kelley, in 1785 at Russell County, Virginia, USA.
- Death*: John Counts Jr died on 1 October 1843 at Cleveland, Russell County, Virginia, USA.
- Note*: He See Historical Document. John Counts of Cleveland. Sketch by Elihu Jasper Sutherland Counts Reunion John Counts was born about 1765 and died October 1, 1843, at Cleveland Russell Co., VA, where he had lived for more than 55 years. For that reason and because there have been so many John Countses in Russell County, he is known as 'John Counts of Cleveland.' His parents Were John and Mary Magdeline ? Counts, who moved from Shenandoah County, VA in 1789, and settled in Glade Hollow, Russell County, Va. For that reason his father is known among his descendants as 'John Counts of Glade Hollow.' The first known record of'John Counts of Cleveland' is found in the personal property tax lists for Shenandoah County for 1787, which reports a tithable over 21 years of age in the family of Jacob Raresnake, his brother-in-law. His name does not appear in any subsequent tax listfor thatcounty. He moved to Russell County during the same year, and the Russell County tax list shows a John Counts assessed as of 21 June 1787, the owner of one horse, and living in the Upper District. The one tithable listed in his family indicates that he was married and head of a family at that date. Russell County Entry Book No. 1, at page 23, gives this data: '1787, Nov 20 - John Counts enters 50 acres of land by part of warrant NO. 14803 dated Nov 9, 1787, lying and beginning at the Widow Lard's old place between that and the River, lying on both sides of a branch that runs into the river.' This tract is included in the town of Cleveland on the south side of Clinch River. He probably established his first home in Russell Countyon this tract. One June 17, 1797, the Grand Jury presented: 'A bill found against Obediah Payne for abusing John Counts and Robing said Counts of his papers and forging an order in the name of Frances Hines presented by the oath of John Counts.' (L O B 1, p 103) The Grand Jury acted again on 26 June, 1791, with 'Presentment against Patrick Coye and John Counts for fishing and 2 CONT breaking the peace the 26th day of April, 1797.' He was an enthusiastic follower of Nimrod the Hunter and roamed the mountain wilderness near his home year after year in search of game. That he was successful is shown by the County Court records, which reveal that he was allowed the following claims: 23 July 1793 - 12/6 (twelve shillings and 6 pence) for 'killing one old wolfe;' and 28 October, 1798 - 25/6 for 'killing two old wolves.' Mr.Counts occasionally sat on the county juries, and only one civil case of record shows him as a party. At the June 1974 term of the County Court he was sued by George McCoy. The case was continued and tried 24 September 1794, the jury finding 'that the defendant did not assume upon himself as in pleadings he (McCoy) hath alleged,' and it was 'considered by the court that the plaintiff take nothing by his Bill.' McCoy's witnesses were Joseph Kiser, Edward Kelley, Abram Childris (Childress), William Smith, James Roberts, and John Craig. Counts' witnesses were Henry Willard, Joseph or James Hatfield, Luke Kelley, and 2 CONC John Damaron. On 1 October 1790, John Counts entered fifty acres of land 'on north side of Clinch River adjoining the land of Cornelius Robt. Dec'd on his east line and on both sides of the path leading from sd. Roberts to Dumps Creek that crosses the low gap.' However a marginal anotation states 'This entry void war'd Ass'd to Rich. Price.' On 24 May 1800, 'John Counts, Junr.' entered 'fifty acres of land by Virtue of part of a Land Office Treasury Warrant No. 2438, dated March 14, 1798, lying in Russell Co. on the south side of Clinch River Beginning at a walnut on the line of sd. Counts land and running up the River on the said line till about two poles below the mouth of Joseph McRenals Spring Branch then nearly a south course thence westward then to the Beginning.' In March 1798, he purchased a tract of 165 acres from Richard and Lucy Price on Clinch River. This tract was on the north side of Clinch River, opposite his 50 acre entry in 1787, and is the tract on which he lived the latter part of his life. We are meeting today on this tract of land. His first residence on this tract stood near a bold limestone spring near the north end of the present bridge. Later this log house was moved up the hill about one hundred yards

Subj: James Kelley Date: 95-03-12 13:49:44 EST From: DHorzen To: Strude Dave, Hard to know where to begin with James Kelley, since there are so many cloudy areas in his life, and there is some conflicting information. But I shall pass on what substantiated info I have. from Rev. War Pension Appl Index: Kelley, James 971466 S16903 b. Aug 1756. Landed in America 1773. Enlisted Greenbriar Co. 1777 Served 3 yrs. as a private. Enlisted 1780-81. Afterward lived in VA, KY, TN. In 1820 he moved to ?. Applied for pension 9 May 1833 in Cooper Co MO. The actual National Archive records contain only information from descendents, and no actual documentation. I have not yet written for the MO records. Supposedly all of the Kelley boys fought in the Rev War, so goes family lore. From an oral interview of Absalom Kelley (grandson of James Kelley) James Kelly was born in Ireland (can't give dates); married Rose Keiser, and had a large boat. His business was to carry goods from New Orleans up the Mississippi River and its northern tributaries. He kept his boys with him on the boat.' Further, 'he was a distiller and steamboat operator on the Ohio and Mississippi rivers. 1815-1825 approx. dates of residence in Pike Co OH. Squatter's homestead, no apparent record of land ownership. A letter in James Kelley pension application file from his granddaughter, Neda Bell, states that James had 16 ch. from before and after 1800 (whatever that means), and Malvina Martin's obit (dau. of son Joseph) stated he had eight sons and eight daughters. The children were born over 30 yrs., so probably was more than one wife involved. There is quite a gap 'between the oldest daughter Gency (b. 1785) and Samuel (b. 1798) which contains the names of boys who never married and lived most of their lives among the native Ohio Indians. This connection with the natives has never been made very clear, although there is much evidence to substantiate it. Frances O'Meara wrote in 1951, 'Rose Kaiser was a full-blooded Miami Indian. The family spoke the language. One son Charles was living with the Indians at the time of his death. The Indians would come to Sam Kelly's home and shoot chickens with their bows and arrows.' By 1830 James Kelley had migrated to Cooper Co MO with his wife and several of their children. The older children remained some years in Pike Co.. Some of the older boys migrated to Green Co WI via Vermillion Co IL.

Sutherland, I sure was pleased to get your letter and the pictures, and I thank you for sending me the pictures. I wish you had sent your picture too. I do get homesick to see you all, but I guess that will never be, unless you all take a notion to come to Mo. I can't forget the good times me and your mother use to have playing together when we were just little kids. We are having some real cold weather the last week or two, and my rheumatism is lots worse - suffer pain all the time in my knee joints. I can't sympathize with your mother if she has rheumatism as bad as I do. I never would have recognized Ida and I'm glad you sent me her picture. And I can't figure out who Bitha Dyer (Counts) is, but guess when I see Ethel she can explain to me who she is. I havn't got to be with Ethel only a short time since she got back from VA., but she did enjoy being at the reunion. You know she lives in Springfield about fifty mile from where I have been staying this Summer. I have been staying with Dora (my oldest daughter) out on a farm this Summer, but I will go and stay with Ethel this winter - then she will tell me all about her VA. trip, and my kinfolks and the reunion. I will go to Marshfield next Sunday and spend a month or two with Josh (my oldest boy) before I go to Springfield. So you write to me real soon and send my letter to Marshfield, Mo., c/o J.C. Grizzel. Tell your mother to please write me a letter. I am so anxious for Ethel to tell me about my people in VA. and that is what she will do when I go stay with her a few months - for she is a great talker - guess you found that out though when she was at the reunion. She is awfully good to me and I do love to stay with her, but would rather be in a home of my own, but I haven't got it. So I just have to live around with the kids. Write again. Best wishes and love to you. --Copy of letter to E.J. Sutherland, October 20, 1937 @S11053@
